In May 2016, the Indiana Department of Environmental Management (IDEM) issued a first notice of rulemaking indicating its intention to revise the Indiana Solid Waste Management Plan (SWMP) to more comprehensively address coal ash disposal. The Indiana rule will have to be at least as stringent as the federal rule. The Hoosier Environmental Council joined a coalition of Indiana groups submitting comments on how IDEM should proceed with a coal ash rule.
As of February 2019, IDEM has not released a draft rule or a second notice of rulemaking. IDEM staff have stated that they are working internally on drafting the state coal ash rule including examining how the 2016 and 2018 court rulings pertain.
